By using this Web site, you agree to be bound by these rules and regulations, as they may be modified by Zoosch Trading CC at any time and posted on this Web site. In the event of a violation of these rules and regulations, Zoosch Trading CC reserves the right to seek all remedies available by law and in equity.
DETAILED DESCRIPTION OF GOODS AND SERVICES OFFERED
Zoosch Trading CC is a South African based company. Zoosch specialises in quality affordable stainless steel jewellery and accessories. The ZOOSCH brand was established in 2010.
CUSTOMER PRIVACY POLICY
Zoosch.co.za shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA).
GOVERNING LAW
The Conditions will be exclusively governed by and interpreted in accordance with the laws of South Africa whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.
LIMITED LICENSE
Zoosch Web Site and all of its content, including, but not limited to, its software or text, artwork, photographs, icons, images, video, and audio (collectively, “Content”) are protected by copyright laws and other South African and international laws and agreements. All Content is provided by Zoosch Trading CC as a service to its current and prospective customers and may only be used for personal informational and product ordering purposes.
No right, title or interest in our Content is conveyed to you. The Contents of this website www.zoosch.co.za, are intended solely for personal, non-commercial use by the users of this site. You may download or copy the Contents and other downloadable materials displayed on this site for your personal, non-commercial use only, provided you do not modify, obscure, or delete any copyright or other propriety notices on this site. ZOOSCH trademarks may not be used in connection with any product or service that is not Zoosch, in any manner that is likely to cause confusion among customers, or in any manner that denigrates or discredits Zoosch.
You may only use this site to browse the content, make legitimate purchases and shall not use this site for any other purposes, including without limitation, to make any speculative, false or fraudulent purchase. This site and the content provided may not be copied, replicated, republished, uploaded, posted, conveyed or distributed. Unlawful use of this site and/or materials contained in this site may violate copyright, trademark or other intellectual property laws or other laws.
No license to the use of such trademarks, names, all images, logo’s is granted to you under these terms and conditions or by your use of the Zoosch website. PEACE OF MIND
Buying products on the internet may be daunting, because you are unable see or touch the product you wish to order. In light of the above we will arrange to pick up and refund you for any products that didn’t quite match up to your expectations. Kindly contact us within 2 days of our delivery to you and we will arrange a collection of any unused products and refund you when it gets back to our warehouse. Unused means: physically undamaged, tags and marketing material attached and in original packaging. (This does not apply to earrings or any other piercing products due to hygienic reasons)
You are entitled to cancel your order, without reason and without penalty in terms of the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”):
• within 7 days after your receipt of the Products; or
• within 7 days of your receipt of an Order Confirmation
You will be required to pay the courier cost of returning the Products to us if returned in terms of this clause.
If you cancel the order in terms of this clause, you will be entitled to a refund after deducting costs of delivery, which we will pay within 15 working days of the date of cancellation.
PAYMENT OPTIONS ACCEPTED
Payment may be made via Visa, Master Card, or eft using the Payfast portal available on the Zoosch website. We do not accept payments from Diners or American Express credit cards.
CREDIT CARD SECURITY
Credit Card Acquiring and Security Credit Card transactions will be acquired by Payfast who are the approved payment gateway for Zoosch Trading CC. Customer Details will be stored separately from Card Details, which may be entered by the customer on the zoooscH.co.za website.
MERCHANT OUTLET COUNTRY AND TRANSACTION CURRENCY
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is ZAR (South African Rand).
COUNTRY OF DOMICILE
This website is governed by the laws of South Africa and zoosch.co.za chooses as its domicilium citandia et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature:

DELIVERY POLICY
When you click to make a purchase with us legal obligations arise and your right to refund of monies charged to your credit card or paid in any other way agreed by us, are limited by our terms and conditions. You may not make a purchase through this site unless you understand and agree to all our terms and conditions. Once payment has been made for your purchase, it is deemed that you have read and understood the terms and conditions. Subject to availability and receipt of payment, requests will be processed within 2 working days and delivery confirmed by way of an order number/tracking number via email. Upon purchasing any items on this website, the prices on the website do not include any Delivery/ Shipping costs.
We reserve the right to charge a reasonable fee for the delivery of orders to you. The total cost of delivery/shipping method will be confirmed in the Order Confirmation tab.
CANCELLATIONS, RETURNS AND REFUNDS
All our items are inspected prior to shipping. In the event that you have received the incorrect item (due to our error) or a defective item, kindly contact us within 14 days of purchase and we will happily exchange, replace or give you a refund on your purchase price (less shipping costs). Please retain your proof of purchase or pass it on to the gift recipient. Kindly note we cannot exchange, replace or refund you without the original proof of purchase.
If you receive your purchase and realise you have ordered the incorrect item, we will gladly exchange the item for you provided it’s within 14 days from the date of purchase. Items need to be returned unused, in the original condition that they were received, with packaging undamaged and intact. Any item not in its original condition, is damaged or has missing parts for reasons not due to our error, or any item that is returned more than 14 days after date of purchase will not be accepted. Please retain your proof of purchase or pass it on to the gift recipient. Kindly note we cannot exchange, replace or refund you without the original proof of purchase.
All returns and exchanges must be sent back to us via courier service and not via postal service. Customers will be responsible for all courier charges.
Necklace and bracelet clasps come with a 6 month warranty. Please retain your proof of purchase or pass it on to the gift recipient as the original proof of purchase is the warranty. If there is a mechanical fault with the clasp within the warranty period we will repair or replace the clasp free of charge. If your jewellery is outside of the warranty period, or where there is no proof of purchase, these services will be at a small cost. Please contact us for more information, info@zoosch.co.za.
Please note: earrings are exempt from being returned due to hygiene reasons.
All returns, exchanges, and replacements are entirely at the discretion of the Zoosch quality control representative.
Refunds, Exchanges, and Replacement Process
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund, exchange, or replacement.
If it is approved, then your refund will be processed within 7 days and a credit will automatically be applied to your bank account. Your refund may take a few days to reflect, depending on your banking institution. Approval of exchanges and replacements are processed within 3 working days. Courier charges will be applied depending on the outcome of inspection.
The Provision of goods and services by zoosch.co.za is subject to availability.
SALE ITEMS
Only regular priced items may be refunded, exchanged, or replaced. Unfortunately, sale items cannot be refunded, exchanged, or replaced.
DISCLAIMER OF WARRANTY
The contents of this site are provided “as is” without warranty of any kind, either expressed or implied, including but not limited to warranties of merchantability, fitness for a purpose and non-infringement.
The owner of this site, the authors of these contents and in general anybody connected to this site in any way, from now on collectively called “Providers”, assume no responsibility for errors or omissions in these contents.
The Providers further do not warrant, guarantee or make any representation regarding the safety, reliability, accuracy, correctness or completeness of these contents. THE USE OF THE SITE BY CHILDREN
